Foreign nationals who wish to enter the United States for certain business or investment purposes must obtain one of several non-immigrant worker “E” visas. U.S. Citizenship and Immigration Services typically issues these credentials to qualifying business owners, principals, investors and traders who have business interests or obligations in the United States.

Types of E-Visas

There are three different types of so-called E-visas. Each pertains to a different class of non-immigrant worker and is described in detail on a separate page on our website:

  • E-1 Visa for Treaty Traders: These pertain to executives, business owners and other “essential workers” who must enter the United States to attend to substantial trading or business interests here.
  • E-2 Visa for Treaty Investors: These pertain to foreign investors who wish to begin or invest in large-scale U.S. businesses.
  • E-3 Visa for Treaty-Bound Australian Nationals: These special visas pertain specifically to Australian citizens and certain qualifying family members who come to the United States to engage in a broad range of business activities.

Treaty Investors

For the purposes of these visas, “Treaty Investors” are defined as individuals capable of investing more than $1 million in a qualifying U.S. business. If the investment occurs in a qualifying economic “priority zone”, this limit can be reduced to $500,000. Meanwhile, both “Treaty Traders” and “Treaty Investors” must enter the United States for business purposes but may bring their family members and certain qualifying domestic servants along for the duration of the trip.

The United States maintains visa treaties with more than six dozen countries, including:

  • Argentina
  • Canada
  • Germany
  • Italy
  • Israel
  • Pakistan
  • United Kingdom
